Terms of Service

These Terms of Service govern your use of the defoltlabs.com website and the products and services provided by Defolt Labs Limited ("Defolt Labs", "we", "us"), a company based in Dar es Salaam, Tanzania. By using the website or our services, you agree to these terms. They are governed by the laws of Tanzania.

• Defolt Retail System (DRS): retail software provided on a subscription, described on our DRS page.
• Defolt Health System (DHS): clinic software for dental, eye, general, maternity and polyclinic practices, described on our DHS page.
• Custom software and support: work delivered under a separate written agreement (a proposal, quote, or contract), which takes precedence over these terms for that work.
• Free developer tools: provided as they are, for convenience.

Where a signed agreement, order form, or written quote covers your engagement, that document governs the specifics (scope, price, timelines); these terms cover everything not addressed there.

• You are responsible for the accuracy of the information you give us and for keeping your account credentials secure.
• You are responsible for the activity that happens under your account.
• You must not misuse the services, attempt to break their security, or use them to break the law.

• Subscription products (such as DRS) are billed on the plan you select. Prices and plan limits are shown when you open an account and may change with notice.
• Payments are handled by our licensed payment provider. You are responsible for the fees for the plan you subscribe to.
• Custom work is billed as set out in its separate agreement.

How we handle personal data is described in our Privacy Policy. For DRS and DHS, the data your shop or clinic puts into the system belongs to you; you are responsible for using it lawfully and for your own obligations toward your customers, staff, or patients. Defolt Labs processes that data to run the service for you.

We work to keep the services available and reliable, but we do not promise a specific uptime or service level unless a separate written agreement says so. Some features are still being built and may change, and are offered without a commitment to a service level.

Defolt Labs owns the software, designs, and content of our products and this website, except for your own data and any materials you provide. Ownership of work built to order is set out in that work's separate agreement.

To the extent permitted by Tanzanian law, the services are provided "as is", and Defolt Labs is not liable for indirect or consequential loss. Nothing in these terms limits any liability that cannot be limited by law.

• We may update these terms; material changes will be posted here with a new "last updated" date.
• You may stop using the services at any time. We may suspend or end access for misuse, for an unpaid account, or as required by law.
